LEGAL DISCLAIMER — D2 Consulting LLC, DBA D2 | Eventful Creatives

BUSINESS ENTITY: D2 | Eventful Creatives is a trade name and division of D2 Consulting LLC, a limited liability company registered in the State of Georgia. All transactions, agreements, and legal obligations are entered into by and with D2 Consulting LLC.

NATURE OF SERVICES: D2 | Eventful Creatives provides custom digital graphic design services for student athletes and their families. Our products include, but are not limited to, custom sports edits (personalized athlete graphics), custom fundraiser gameboard flyers, and bundled design packages. All products are custom-made digital files, not mass-produced or pre-made templates.

NO GUARANTEE OF FUNDRAISING RESULTS: While our fundraiser gameboard flyers are designed to support your athlete's fundraising efforts, D2 | Eventful Creatives does not guarantee any specific fundraising outcome, dollar amount raised, or response rate. Fundraising results depend on factors outside our control, including but not limited to distribution, audience, timing, and personal outreach efforts.

USE OF ATHLETE IMAGES: By submitting a photograph of a student athlete, you confirm that: a. You are the parent or legal guardian of the minor depicted in the photograph, or you have obtained explicit written consent from the parent or legal guardian to submit the image. b. The photograph was taken legally and is not subject to any third-party restrictions that would prevent its use in a custom design. c. You grant D2 Consulting LLC, DBA D2 | Eventful Creatives, permission to use the photograph solely for the purpose of fulfilling your order and, unless otherwise requested in writing, for display in our portfolio and marketing materials.

THIRD-PARTY TRADEMARKS: Custom designs may include school names, team names, mascots, or logos at the customer's request. D2 | Eventful Creatives does not claim ownership of any third-party trademarks, logos, or intellectual property. The customer assumes responsibility for ensuring they have the right to use any school, club, or organizational branding they request to be included in their design. D2 | Eventful Creatives shall not be held liable for any trademark infringement claims resulting from the customer's requested use of third-party branding.

ACCURACY OF INFORMATION: The customer is responsible for providing accurate information on their design details form, including but not limited to athlete name, team name, jersey number, team colors, and payment method details (for fundraiser gameboards). D2 | Eventful Creatives is not liable for errors in the final design resulting from incorrect information provided by the customer.

LIMITATION OF LIABILITY: D2 Consulting LLC, DBA D2 | Eventful Creatives, shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from: a. The use or inability to use our products or services b. Errors or inaccuracies resulting from incorrect information submitted by the customer c. Unauthorized access to or alteration of your data d. Any third-party claims related to the content of your custom design e. Fundraising outcomes or lack thereof

Our maximum liability for any claim shall not exceed the total amount paid by the customer for the specific order in question.

DISPUTE RESOLUTION: In the event of any dispute arising from or related to these terms or our services, both parties agree to first attempt to resolve the dispute informally by contacting D2 | Eventful Creatives directly. If informal resolution is not successful, any legal proceedings shall be conducted in the courts of the State of Georgia, Gwinnett County.

SEVERABILITY: If any provision of this Legal Disclaimer is found to be unenforceable or invalid, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

CHANGES: We reserve the right to modify this Legal Disclaimer at any time. Changes will be posted on this page with a revised effective date.
